Lawyers Assist with Restraining Orders
Bethany Coolen
Filing a restraining order can be a terrible ordeal. When the fear and threats force you to decide to file for a restraining order, be prepared, it will not be as simple as it sounds. One would assume that with the prevalence of domestic violence stories in the news that filing a restraining would be protection from a repeat abuser. Unfortunately this is not always true. Although most laws are written with the welfare of victims in mind, cops often are reluctant to provide intervention.
In truth, it is almost impossible to correctly file a legally valid restraining order without the help of a lawyer. Emergency response to physical danger related to restraining orders is supposed to be quick and easy, but it is often quite difficult, or near impossible to enforce. However, there is no assurance that filing a restraining order will deter an abuser from harassing you or your family. If they hurt you, they will be prosecuted in the long run. But in the immediate future, you are still in danger.
Often times a restraining order can make things go from bad to worse. Frequently, a restraining order will enrage an abuser, rather than giving them a warning that they must stop their abuse. Sometimes a restraining order is sufficient to frighten away abusers, but they often end up as a catalyst for something more serious. Something that would have been considered slight harassment previously, might become hazardous now, and something that was hazardous could become deadly. A restraining order can offer deterrence, but it is not guaranteed protection.
However, a qualified attorney can get you the help you need; before the unthinkable happens. Lawyers fully grasp how the entire system functions, both practically and theoretically. Lawyers are familiar with local police practices, know the hoops you will need to jump through to get effective protection, and have developed understandings of how the minds of stalkers and abusers work. Getting a restraining order is not all that you may need for protection, but it is a first step. You must hire an attorney in order to get and enforce a restraining order. It could be the difference between life and death.
