In a case, currently in the American courts, Jewel versus NSA, Electronic Frontier Foundation is taking on the giants of the United States, on behalf of AT&T customers.
Earlier this year Congress passed legislation , giving telecommunication firms protection from lawsuits involving spying. This has halted a case in the Federal Court, involving AT&T. EFF then opted to open a second battle front by demanding those participating in, or having authorized the fishing expedition, be held accountable. An ongoing warrantless surveillance dragnet caused millions of ordinary Americans' emails to be read, as copies of communications and records of Internet Traffic are forwarded to a secret room in San Francisco.
Michael Mukasey, the US Attorney General has disputed the existence of the dragnet, while asking for immunity from a Federal Judge, for the communication companies.
High profile people like President George W. Bush, Vice President Dick Cheney, Chief of Staff David Adding ton, former Attorney General and White House Counsel Alberto Gonzales and others, as well as NSA, are on the list being prosecuted .
Internet Service Providers now find themselves in a very different position. They hold their users' secrets, relationships, acts, conversations and omissions. Up to now the ISP's have left the spying business alone, but with the more recent advances in eavesdropping technology, people can be spied on in ways never previously done.
Advertisers, along with copyright owners, have been trying to tempt the ISP to give up their users' secrets for financial return . It would appear the ISPs are giving in to the new temptation and are experimenting with ways to spy on their customers . This could be the thin edge of the wedge of a vast new round of invasive surveillance .
How can governments continue to defend themselves and their citizens from repeat attacks from terrorist attacks, such as September 11, without being thought to simply be overzealous sticky beaks ? Gone are the times when you believe you can trust people. Everybody is outfor themselves.
