Seattle Accident Attorney - Personal Injury Cases

Hoping to provide everybody the resources and knowledge to know how to fight their personal injury lawsuit, Seattle car accident attorney Jason Epstein talks about the legal process that drives personal injury cases.

It is very common for my clients to ask me about the legal process that will take place in their personal injury case, because they want to know what the road ahead will look like. It is important that as an attorney, I can communicate the legal lingo that is only understandable to people with a law degree, into plain english for my clients. Hopefully this breakdown will give you a better grasp on what is ahead if you pursue an injury claim.

1st step: Starting a summons and complaint with the court and having the defendant served with the documents. This informs the party that is being sued that somebody is suing them.

2nd step: Discovery.?This is where each side basically sends questions to each other to get a better idea of the case they are developing. This can happen in one of two ways. Either each side will send the other questions about their case that must be truthfully answered, or there will be a deposition, in which case you will be questioned by the other side with court reporter present in the room.

3rd step: Mediation. This is where both sides work at settling a case outside of court. There is a mediator present who tries to negotiate an agreement with both sides so the case can settle.

4th step: Arbitration. If mediation fails, you can take the case to arbitration, which is sort of a miniature version of a trial. If the case is valued at $50,000 or less, then the two sides can argue their case in front of an experienced attorney who will weigh the evidence and award the case

5th step: If negotiation doesnâ??t get you what you deserve, the final step is trial. This is where your case would be heard in front of a jury, or judge, which will decide who is awarded what
